Terms & Conditions
Terms & Conditions
These Terms & Conditions govern your use of the English Art Works website and any purchases made through it.
Please read them carefully before using the website or placing an order. By using this website, you agree to these Terms & Conditions. If you do not agree to them, please do not use the website.

2. These Terms
These Terms & Conditions apply to:
- your use of this website; and
- any order placed through this website for goods offered by English Art Works.
Separate terms may apply to certain services, events, bespoke commissions, alterations, restoration work or other specialist arrangements where stated.
3. Use of the Website
You may use this website only for lawful purposes.
You must not:
- misuse the website or knowingly introduce malicious code;
- attempt to gain unauthorised access to the website or its servers;
- copy, reproduce or exploit website content for commercial purposes without written permission;
- use the website in any way that may damage, disrupt or impair its availability or functionality.
We may update, withdraw or change the website or any part of it without notice.
4. Product Information and Availability
We aim to ensure that all descriptions, images, dimensions, pricing and other product information on the website are accurate. However, errors may occasionally occur.
Many goods offered by English Art Works are antique, vintage, restored, conserved or otherwise aged by time and use. As a result:
- variations in tone, patina, finish and wear may be part of the nature of the item;
- minor differences between photographs and the item seen in person may occur due to screen display, lighting and photography;
- dimensions and weights may be approximate unless stated otherwise;
- one-off pieces may be subject to prior sale.
All goods are offered subject to availability. The inclusion of an item on the website does not guarantee that it remains available for purchase.
5. Orders and Acceptance
When you place an order, you are making an offer to purchase the item.
A contract is formed only when we accept your order. We reserve the right not to accept an order, including where:
- the item is no longer available;
- there has been an error in pricing or description;
- we are unable to obtain authorisation for payment;
- we reasonably suspect fraud, misuse or unlawful activity;
- delivery to the stated address is not possible.
If we cannot accept your order after payment has been taken, we will notify you and refund the amount paid as soon as reasonably possible.
6. Pricing and Payment
All prices shown on the website are in Pounds Sterling (£) unless otherwise stated.
Prices may include VAT where applicable. If VAT applies, this should be made clear at checkout or in the product listing.
Delivery charges, where applicable, will be shown before you complete your order.
We reserve the right to change prices at any time, but changes will not affect orders already accepted.
If a pricing error is identified before your order is accepted, we are not obliged to sell the item at the incorrect price.
Payment must be made using the payment methods made available at checkout.
7. Delivery
We aim to dispatch and deliver orders within the timescales stated on the website or at checkout, but all delivery times are estimates unless expressly stated otherwise.
Further details regarding shipping methods, destinations, charges and delivery times are set out on our Delivery page.
Risk in the goods passes to you on delivery. Ownership of the goods passes to you when we have received payment in full.
8. Your Right to Cancel
If you are a consumer purchasing online, you generally have the right to cancel your order within 14 days of receiving the goods, without giving a reason. You then have a further 14 days to return the goods. These are core UK distance-selling rights and should be clearly disclosed on the site.
To exercise this right, you must notify us within that 14-day period.
Refunds will be made in accordance with applicable consumer law and our Returns & Refunds page.
Your right to cancel may not apply, or may be limited, in relation to certain goods, including:
- bespoke or commissioned items;
- personalised or engraved items;
- items altered at your request after purchase;
- sealed goods not suitable for return for hygiene reasons if unsealed after delivery, where applicable.
Nothing in these Terms affects your statutory rights. Consumer rights guidance in the UK also makes clear that websites should provide key pre-contract information, including delivery and cancellation information, before purchase.
9. Returns and Refunds
Please see our Returns & Refunds page for full details of how to return goods, applicable timelines, and how refunds are processed.
Returned goods should be sent back in the condition in which they were received, together with any presentation boxes, paperwork, certificates or accompanying materials where relevant.
We reserve the right to make an appropriate deduction from a refund where the value of the goods has been reduced by handling beyond what is reasonably necessary to establish their nature, characteristics and function.
10. Faulty, Misdescribed or Not-as-Described Goods
If an item is faulty, materially misdescribed, or not of satisfactory quality, you may be entitled to a repair, replacement, refund or other remedy under applicable consumer law.
If you believe there is a problem with an item, please contact us promptly at [contact email].
Nothing in these Terms excludes or limits any rights you may have under applicable consumer law.
11. Vintage, Antique and Restored Goods
English Art Works specialises in vintage, antique and restored goods, many of which are one-off items with age, use and history.
Unless expressly stated otherwise:
- signs of age and use may be present;
- historic wear, minor imperfections, surface variation, patina and evidence of earlier repair may form part of the character of the item;
- restoration or conservation may have been carried out prior to sale where appropriate.
We aim to describe condition carefully and honestly, and buyers should read descriptions, condition notes and measurements with care before purchase.
The presence of age-related character or sympathetic restoration does not of itself make an item faulty.
12. Bespoke, Personalised and Altered Items
Where goods are made to order, commissioned, engraved, resized, altered or otherwise personalised at your request, they may not be eligible for cancellation, return or exchange unless faulty or not as described.
Any such position will be stated where relevant.
13. Intellectual Property
All content on this website, including text, images, branding, logos, graphics, page layout and design, is owned by or licensed to English Art Works unless otherwise stated.
You may not reproduce, distribute, publish, modify or commercially exploit any part of the website without prior written permission.
14. Liability
Nothing in these Terms excludes or limits liability for:
- death or personal injury caused by negligence;
- fraud or fraudulent misrepresentation;
- any matter that cannot lawfully be excluded or limited.
Subject to the above, we shall not be liable for any indirect or consequential loss, or for any loss not reasonably foreseeable arising from use of the website or the purchase of goods through it.
We do not exclude liability for goods where such liability cannot be lawfully excluded under consumer law.
15. Privacy and Cookies
Our use of personal data is governed by our Privacy Policy.
Our use of cookies and similar technologies is governed by our Cookie Policy. The ICO requires websites using cookies and similar technologies to explain their use clearly, and consent is required for non-essential cookies unless an exemption applies.
Please read those pages carefully.
16. Changes to These Terms
We may amend these Terms & Conditions from time to time.
The version published on the website at the time of your use of the website or placement of an order will apply.
17. Governing Law and Jurisdiction
These Terms & Conditions are governed by the law of England and Wales.
Any dispute arising in connection with these Terms or any purchase made through the website shall be subject to the jurisdiction of the courts of England and Wales, unless applicable consumer law provides otherwise.
